Πώς η Frontex συγκάλυπτε τις παρανομίες στο Αιγαίο

Ανακολουθίες, υπεκφυγές, δικαιολογίες, αντιφάσεις, αναληθείς αναφορές, μυστικά και ψέματα, ένα ολόκληρο οπλοστάσιο μεθοδεύσεων χρησιμοποίησαν τουλάχιστον από το 2020 υψηλόβαθμα στελέχη της Frontex για να συγκαλύψουν τις επαναπροωθήσεις του Ελληνικού Λιμενικού, ώστε να μην υπάρξει λογοδοσία για βαρύτατες παραβιάσεις του διεθνούς και ευρωπαϊκού δικαίου και να συνεχιστούν οι εγκληματικές πρακτικές του στα θαλάσσια ευρωπαϊκά σύνορα.

Οι μεθοδεύσεις αυτές καταγράφονται βήμα βήμα στο απόρρητο πόρισμα-κόλαφο της Ευρωπαϊκής Υπηρεσίας για την Καταπολέμηση της Απάτης (OLAF) που ερεύνησε την εμπλοκή της Frontex σε παράνομες επαναπροωθήσεις στο Αιγαίο και στη συγκάλυψή τους.

Ολόκληρο το πόρισμα, έκτασης 219 σελίδων και προϊόν πολύμηνης εξαντλητικής έρευνας που περιλάμβανε συνεντεύξεις με 20 αξιωματούχους της Frontex, εσωτερική ηλεκτρονική αλληλογραφία στην υπηρεσία και επιτόπια έρευνα στα γραφεία της υπηρεσίας στη Βαρσοβία, δημοσιοποιήθηκε χτες για λόγους δημοσίου συμφέροντος από το γερμανικό περιοδικό Spiegel, την ερευνητική ομάδα Lighthouse Reports και τη γερμανική οργάνωση για την ελεύθερη πληροφόρηση FragDenStaat και στην Ελλάδα από την ερευνητική ομάδα Reporters United.

Στοιχεία του πορίσματος είχαν δημοσιοποιηθεί σε ευρωπαϊκά μέσα ενημέρωσης την άνοιξη. Ωστόσο το ίδιο το πόρισμα κρατούνταν επτασφράγιστο μυστικό από την OLAF και τη Frontex, ακόμα και από την αρμόδια Επιτροπή Πολιτικών Ελευθεριών του Ευρωκοινοβουλίου (LIBE), σε μέλη της οποίας δόθηκε καθυστερημένα περιορισμένη πρόσβαση στο έγγραφο σε συνθήκες εμπιστευτικότητας.

Το πόρισμα διαπιστώνει ότι αυτές οι μεθοδεύσεις και ενέργειες των στελεχών της Frontex παραβιάζουν τον εσωτερικό κανονισμό και τον υπαλληλικό κώδικα της Frontex όπως και σειρά ευρωπαϊκών κανονισμών, καθώς επηρέασαν την ικανότητα της Frontex να δρα με σεβασμό στο ευρωπαϊκό δίκαιο και στα θεμελιώδη δικαιώματα και να διασφαλίζει τη συμμόρφωση με τα θεμελιώδη δικαιώματα στα ευρωπαϊκά σύνορα.

«Βάσισαν τις αποφάσεις τους στις προσωπικές τους προκαταλήψεις και τη χαμηλή εκτίμηση που έτρεφαν για την Ευρωπαϊκή Επιτροπή, ιδίως ορισμένους αξιωματούχους [που] θεωρούσαν υπερβολικά προσηλωμένους σε θέματα θεμελιωδών δικαιωμάτων και στη γραφειοκρατία, χωρίς κατανόηση των επιχειρησιακών προκλήσεων στη διαχείριση των εξωτερικών συνόρων», αναφέρεται χαρακτηριστικά.

Το πόρισμα οδήγησε την άνοιξη στην πολύκροτη ταπεινωτική παραίτηση του διευθυντή της Frontex Φαμπρίς Λετζέρι, βραβευμένου λίγο νωρίτερα για τις υπηρεσίες του από τον υπουργό Μετανάστευσης και Ασύλου Νότη Μηταράκη, προκειμένου να αποφύγει να κινηθεί εναντίον του πειθαρχική διαδικασία και να υπάρξουν κυρώσεις. Η OLAF καταγράφει αναλυτικά τις μεθοδεύσεις συγκάλυψης των επαναπροωθήσεων σε σειρά περιστατικών. Μεταξύ αυτών:

● Την καταχώριση των περιστατικών επαναπροώθησης όχι στην τέταρτη κατηγορία των Αναφορών Σοβαρού Περιστατικού, η οποία αφορά περιστατικά παραβίασης θεμελιωδών δικαιωμάτων που πρέπει να διερευνηθούν για να υπάρξει λογοδοσία, αλλά σε άλλες κατηγορίες. «Αυτό οδήγησε στον αποκλεισμό του αξιωματικού θεμελιωδών δικαιωμάτων από την αξιολόγηση και τον χειρισμό ορισμένων περιστατικών, παρά την πιθανή ύπαρξη ενός στοιχείου [παραβίασης] θεμελιωδών δικαιωμάτων […]».

● Την απόφαση να αλλάξει πορεία αεροσκάφος της Frontex σε άλλη επιχειρησιακή περιοχή, γεγονός που μπορεί με βάση τα στοιχεία να ερμηνευτεί «σαν προσπάθεια να αποφευχθεί η μαρτυρία περιστατικών στο Αιγαίο που πιθανότατα περιλαμβάνει στοιχείο [παραβίασης] θεμελιωδών δικαιωμάτων».

● Το γεγονός ότι απέφυγαν να επανέλθουν στην εξέταση ενεργειών που ενδεχομένως αφορούν την εφαρμογή του άρθρου 46 του Κανονισμού της Frontex, το οποίο προβλέπει την απόσυρση των δυνάμεων της υπηρεσίας σε περιοχές όπου γίνονται παραβιάσεις θεμελιωδών δικαιωμάτων.

● Την επανειλημμένη επί σειρά ετών προσπάθεια να περιοριστεί η πρόσβαση αξιωματούχων θεμελιωδών δικαιωμάτων σε στοιχεία, πληροφορίες και συστήματα επικοινωνίας, με τρόπο που παρεμποδίζει το έργο τους.

● Tην απόκρυψη βίντεο του τουρκικού Λιμενικού από αξιωματικούς θεμελιωδών δικαιωμάτων τον Φεβρουάριο του 2021.

● Την απάλειψη αναφορών σε πιθανές παραβιάσεις θεμελιωδών δικαιωμάτων από επιστολές προς τις ελληνικές αρχές ώστε το κείμενο να είναι λιγότερο αιχμηρό πολιτικά και λιγότερο σαφές ως προς τη σοβαρότητα των γεγονότων.

● Τον χαρακτηρισμό περιστατικών ως απόρρητων για λόγους εθνικής ασφάλειας ή άμυνας, προκειμένου να μην έχουν πρόσβαση σε αυτά οι αξιωματούχοι θεμελιωδών δικαιωμάτων, παρά το γεγονός ότι ο υπουργός Ναυτιλίας της Ελλάδας δεν ανέφερε παρόμοιους λόγους στην έγγραφη ενημέρωση για τα περιστατικά.

Ξεπερνούν τις 3000 οι αιτούντες άσυλο στη Λέσβο

Με τις σημερινές αφίξεις, (13/11) 72 προσφύγων και μεταναστών, εκ των οποίων 52 στην Εφταλού και 20 στον Γαβαθά, ο προσωρινός καταυλισμός αιτούντων άσυλο της Λέσβου στον Καρά Τεπέ, ξεπερνά τις 3.000 διαμένοντες.

Συγκεκριμένα μέχρι χτες, Τρίτη 12 Νοεμβρίου άγγιζε τις 2.942 λόγω 144 αφίξεων και 191 αφίξεων της Δευτέρας.

Κι ενώ αυξάνονται οι ροές στη Λέσβο, στα Δωδεκάνησα δεν σημειώνονται αφίξεις.

Ας σημειωθεί πάντως ότι η δυναμικότητα του ΚΥΤ στον Καρά Τεπέ, δηλαδή η δυνατότητα φιλοξενίας είναι μέχρι τις 3.659 άτομα.

Ρόδος: Μετανάστες ζουν σε χαρτόκουτα και σκηνές πριν μεταφερθούν σε οργανωμένες δομές

Σύμφωνα με πρόχειρες εκτιμήσεις, οι μετανάστες που βρίσκονται στη Ρόδο ξεπερνούν τους 700, αριθμός που ήταν ίδιος και την προηγούμενη εβδομάδα, αλλά και δύο εβδομάδες πριν, και που δεν πρόκειται να αλλάξει αν δεν γίνουν μαζικές μεταγωγές σε δομές στην ηπειρωτική Ελλάδα.

Σύμφωνα με όσα επισήμανε χθες στη συνεδρίασή της ΠΕΔ Νοτίου Αιγαίου ο δήμαρχος Ρόδου, Αλέξανδρος Κολιάδης, το ουσιώδες πρόβλημα σε ό,τι έχει να κάνει με το μεταναστευτικό και τον αυξημένο αριθμό μεταναστών αυτή τη χρονική περίοδο στο νησί, αφορά μεταξύ των άλλων, και την έλλειψη σε προσωπικό που καταγράφεται τα τελευταία χρόνια σε υπηρεσίες των Λιμεναρχείων αλλά και της Αστυνομίας, όπως μεταδίδει το rodiaki.gr.

Η κατάσταση, όπως επισημαίνει με δηλώσεις του στη «Ροδιακή» ο πρόεδρος των Αστυνομικών Υπαλλήλων του νησιού, Μανώλης Ανδρουλάκης, «βρίσκεται σε τραγικό σημείο», αφού οι Υπηρεσίες της ΕΛΑΣ «κινδυνεύουν με διάλυση, δεδομένου ότι, μόνο για μια συνοδεία από τη Ρόδο σε άλλες περιοχές της χώρα, οι αστυνομικοί χρειάστηκαν ακόμα και 20 ημέρες».

Το τοπικό Μέσο Ενημέρωσης επισημαίνει πως ουσιαστικές αποφάσεις από τα υπουργεία δεν λαμβάνονται και οι όποιες ενέργειες έχουν γίνει έως τώρα, δεν έχουν επιφέρει λύση στο πρόβλημα, «προσπαθώντας να λύσουν το μεταναστευτικό ζήτημα της Ρόδου και της ευρύτερης περιοχής, με ανταλλαγή emails».

Και μέχρι να βρεθεί λύση, οι μετανάστες εξακολουθούν να κοιμούνται όπου βρουν στο κέντρο της Ρόδου, επάνω σε χαρτόκουτα ή σκηνές που έχουν στήσει. Μάλιστα, σύμφωνα με αξιωματικούς της ΕΛΑΣ, οι ροές είναι καθημερινές από τα γειτονικά παράλια και έτσι «ο συνολικός αριθμός που παραμένει στο νησί, όχι μόνο δεν μειώνεται αλλά αυξάνεται».

Την ίδια ώρα, ο πρόεδρος της Ένωσης Αστυνομικών Υπαλλήλων Νότιας Δωδεκανήσου, Μανώλης Ανδρουλάκης, με δηλώσεις του στη «Ροδιακή» ζήτησε, για ακόμη μία φορά, να αποσυμφορηθούν οι δομές σε Λέρο και Κω μεταφέροντας στην ηπειρωτική Ελλάδα τους μετανάστες που βρίσκονται εκεί και να δημιουργηθούν χώροι.

Αναφορικά με τη δημιουργία περιφραγμένου χώρου στο λιμάνι της Ακαντιάς, όπου θα φιλοξενούνται οι ταυτοποιημένοι μετανάστες, ο κ. Ανδρουλάκης τόνισε, ότι και εκεί είναι συγκεκριμένη η χωρητικότητα, οπότε δεν πρόκειται να υπάρξει σημαντική αλλαγή η οποία θα επέλθει μόνο εφόσον γίνει η μετακίνησή τους σε οργανωμένες δομές στην ενδοχώρα.

Major deficiencies in the provision of interpretation services in Greece

Even asylum interviews are no longer being conducted

Severe deficiencies in interpretation services over recent months have affected both refugee camps in Greece and the Greek Asylum Service. These gaps now hinder the state’s ability to provide essential services.

The problem within the Asylum Service, its Regional Asylum Offices and Asylum Units, has become extremely severe. Asylum registrations and interviews are now postponed or rescheduled due to the absence of interpreters. In some cases, depending on the office involved, asylum seekers are not even informed promptly about these delays. In other instances, appointments are left unscheduled, leaving individuals uncertain of when their registration or interview will take place.

Gaps in interpretation have led to “creative” and unorthodox solutions in certain cases. Asylum applicants are often requested to state their consent to the proceedings being carried out in Greek by signing solemn declarations confirming that they understand the language. Alternatively, third parties, not certified interpreters, may be used to assist as interpreters, with applicants again signing declarations accepting this arrangement. These declarations appear to be designed to shield the Asylum Service from responsibility, even though the law requires that interpretation services be provided by the state in a language understood by applicants throughout the entire reception and identification and asylum process.

Τhree cases represented by Refugee Support Aegean (written responses from the authorities on file) serve as examples of the broader issue:

In a case involving a family with a newborn baby residing in the Ritsona camp, our request to the Piraeus Regional Asylum Office regarding the child’s registration was met with a written response as follows: “As long as there is no interpretation there are two ways to make the registration & applications: 1. The applicant may submit a solemn declaration affirming their ability to understand and communicate in Greek, 2. A third party could act as an interpreter […], provided the applicant signs a statement that they agree to this arrangement and that the Asylum Service is not responsible for the quality of the interpretation provided by the third party.” (!)

Convicting Judgment in the Attack on German Photojournalist Michael Trammer and Racist Violence Against Refugees at the Port of Thermi.

Mytilene, Greece – On Friday, November 1, 2024, the Single-Member Misdemeanor Court of Mytilene issued a verdict on the events of March 1, 2020, at the port of Thermi on the island of Lesvos, concerning the attack on German photojournalist Michael Trammer and the racially motivated acts of violence against newly arrived refugees.

On March 1, 2020, photojournalist Michael Trammer had gone to the port of Thermi to document the arrival of a boat carrying asylum seekers. A crowd of locals had gathered at the port, hurling racist insults and threats at the passengers on the boat, including threats to drown them at sea to prevent them from disembarking. At the same time, they publicly incited violence against them. Some of the gathered crowd even pushed the boat back toward open waters.

While Mr. Trammer was filming the events, a group of young men violently attacked him. They repeatedly kicked and punched him, slamming him against the concrete and stone surfaces of the seawall before forcing him to the ground, causing a severe head wound with heavy bleeding while they continued their assault. They also threw his equipment into the sea, rendering it completely unusable. Mr. Trammer was eventually taken to Mytilene Hospital, where he received stitches, though his transfer was significantly delayed due to roadblocks set up by vigilante groups on Lesvos.

Five individuals were identified and brought to trial for these crimes, although one of them had passed away before the court proceedings began 4.5 years later.

After a thorough examination of the evidence, the court found the four defendants guilty as charged. Specifically, the four defendants—three men and one woman—were convicted of coercion with racist intent against 50 newly arrived refugees, as well as public incitement to violence against them, in violation of the Anti-Racism Law.

Two of the defendants were also convicted of dangerous bodily harm and property damage against Mr. Trammer, with one identified as the primary offender and the other as an accomplice.

The convicted individuals invoked mitigating circumstances; however, only their lack of prior criminal records was considered. Ultimately, the court imposed a prison sentence of 3 years and 1 month, along with a requirement to report to the police station once a month, on the man who was additionally convicted as the primary perpetrator in the assault on Mr Trammer. His accomplice received a prison sentence of 2 years and 5 months. The other two defendants were sentenced to 2 years and 2 months and 2 years and 4 months, respectively. The sentences for these three were suspended, and all four defendants were granted a suspension of sentence pending appeal.

It is worth noting that the attack occurred during a period of extreme violence in Lesvos, marked by daily incidents of vigilante attacks carried out with impunity, where self-appointed groups enforced their own rules and terrorized refugees and human rights defenders, exploiting local resentment over the containment of approximately 30,000 refugees and migrants on the island.

Photojournalist Michael Trammer was represented by HIAS Greece, who would like to thank all journalists and photojournalists who published or shared photos and video footage from that day’s events, helping to identify the perpetrators and support the charges brought against them.

Mr Trammer reflected on the experience, stating, “I have witnessed countless moments of hatred and dehumanization covering events across Europe as a journalist, but the memories of March 1st, 2020, are etched into my memory: a mob with racist motives attacking helpless people in a flimsy rubber dinghy without any engine in an emergency situation—including crying toddlers. I am very glad that, after all these years, the court in Mytilene valued the huge amount of evidence against a few of the participants and some of the instigators, as well as two of a group that attacked me for documenting the events. Up until today, I ask myself why the other participants in this racist mob could not be identified and investigated by police—and why authorities did not intervene on that day.”

Mr. Trammer's lawyer, Elli Kriona-Saranti, welcomed the court’s decision, emphasizing that: “Once again, the Mytilene Court has sent a strong message of zero tolerance for acts of violence against journalists and photojournalists covering the migration issue on Lesvos, as well as for vigilante actions by self-appointed groups. The recognition of a racist motive in the crimes against these newly arrived refugees, fully aligned with the case law of the European Court of Human Rights, underscores the true nature of these acts— not spontaneous expressions of frustration but hate crimes driven by contempt for refugees because of their origin and religion”.

Λέσβος: Ένοχοι οι δράστες της ρατσιστικής συγκέντρωσης και της επίθεσης στον φωτορεπόρτερ Michael Trammer

Ολοκληρώθηκε σήμερα στο Μονομελές Πλημμελειοδικείο Μυτιλήνης η δίκη για τα γεγονότα της 1ης Μαρτίου 2020 στο λιμανάκι της Θερμής στη Λέσβο, όπου πλήθος ατόμων -μερικοί εκ των οποίων επιτέθηκαν και στον φωτορεπόρτερ Michael Trammer- εμπόδιζαν πρόσφυγες από το να αποβιβαστούν στη στεριά.

Το δικαστήριο έκρινε ενόχους τους τέσσερις δράστες Π.Κ., Α.Λ., Γ.Κ.-Μ. και Α.Δ. όπως κατηγορούνται, σύμφωνα και με την εισαγγελική πρόταση. Ένας κατηγορούμενος, ο Φ.Κ. έχει αποβιώσει στο μεταξύ.

Οι τέσσερις δράστες κρίθηκαν ένοχοι αφ’ ενός για τα γεγονότα της ρατσιστικής συγκέντρωσης στο λιμανάκι της Θερμής, όπου εμπόδιζαν πρόσφυγες από το να βγουν στη στεριά, και προέτρεπαν σε πράξεις βίας εναντίον τους, δηλαδή παράνομη βία με ρατσιστικά χαρακτηριστικά κατά συναυτουργία και κατά συρροή και δημόσια υποκίνηση βίας ή μίσους με ρατσιστικά χαρακτηριστικά από κοινού.

Οι δύο εξ αυτών, Π.Κ. και Α.Λ., καταδικάστηκαν και για την επίθεση στον Γερμανό φωτορεπόρτερ Μίκαελ Τράμερ, που συνέβη παράλληλα με τη ρατσιστική συγκέντρωση, για τα αδικήματα της επικίνδυνης σωματικής βλάβης και της φθοράς ξένης ιδιοκτησίας, και τα δύο κατά συναυτουργία και συνέργεια.

Οι καταδικασθέντες ζήτησαν ελαφρυντικά, από τα οποία έγινε δεκτό μόνο αυτό του σύννομου βίου πριν την πράξη. Τελικά το δικαστήριο αποφάσισε ποινή 37 μηνών για τον Π.Κ. χωρίς αναστολή αλλά με αναστέλλουσα ισχύ της έφεσής του, ενώ ποινές με αναστολή πήραν οι Α.Λ. (29 μήνες), Γ.Κ.-Μ. (26 μήνες) και η Α.Δ. (28μήνες).

Έντονες αντιδράσεις προκαλεί στην Περιφέρεια Βορείου Αιγαίου η πρόσφατη επίσκεψη του Γερμανού Ομοσπονδιακού Προέδρου Φρανκ-Βάλτερ Σταϊνμάιερ στην Ελλάδα και η συζήτηση γύρω από την επαναπροώθηση μεταναστών στις χώρες πρώτης υποδοχής. Σύμφωνα με το ρεπορτάζ της εφημερίδας ΕΣΤΙΑ, ο κ. Σταϊνμάιερ κατά την επίσκεψή του στη δομή μεταναστών στη Μαλακάσα υπογράμμισε την πρόθεση της Γερμανίας να επαναφέρει μετανάστες σε χώρες πρώτης υποδοχής, όπως η Ελλάδα και η Ιταλία.

Μια από τις τοποθεσίες που αναφέρονται για την προσωρινή φιλοξενία των επαναπατριζόμενων είναι η Βάστρια, γεγονός που έχει εγείρει ανησυχίες. Η Περιφερειακή Αρχή, με δημόσια δήλωση, εξέφρασε κατηγορηματικά την αντίθεσή της, υπογραμμίζοντας ότι «οι νήσοι του Βορείου Αιγαίου δεν θα γίνουν ξανά κολυμπήθρα του Σιλωάμ της Ευρώπης».

Η δήλωση της Περιφερειακής Αρχής αντανακλά τη διάθεση των νησιωτών, οι οποίοι νιώθουν ότι έχουν ήδη επιβαρυνθεί σημαντικά από τις μεταναστευτικές ροές των προηγούμενων ετών. Τονίζεται ότι οι νησιώτες του Βορείου Αιγαίου «φυλάττουν Θερμοπύλες» και αρνούνται να επωμιστούν επιπλέον βάρη που ενδέχεται να αλλοιώσουν την καθημερινότητά τους και να επηρεάσουν την τοπική κοινωνία.

Το Γενικό Επιτελείο Αεροπορίας έδωσε στη δημοσιότητα το σχετικό βίντεο.

Ελικόπτερο Super Puma της Πολεμικής Αεροπορίας εκτέλεσε χθες, Σάββατο 26 Οκτωβρίου, αποστολή διάσωσης ατόμων στη θαλάσσια περιοχή δυτικά της Σάμου.

Σημειώνεται ότι χθες το μεσημέρι η Λιμενική Αρχή της Σάμου ενημερώθηκε από το Ενιαίο Κέντρο Συντονισμού Έρευνας και Διάσωσης (ΕΚΣΕΔ) του Λιμενικού Σώματος για την ύπαρξη ατόμων στη θάλασσα στην περιοχή παραλίας Πλάκας της Σάμου.

Joint Statement: Provision of cash assistance to asylum seekers in Greece must resume immediately

Asylum seekers in Greece have once again been denied their legal right to dignified living conditions after months of delay in payments of cash assistance, leaving people without an income and unable to meet their basic needs. Beneficiaries of the cash assistance program have been informed via text message that delays are occurring. However, there has been no public announcement from the Ministry of Migration and Asylum regarding the cause of the delays or how long they will last, leaving people in the dark about when to expect payments to resume.

Cash assistance has not been paid out to asylum seekers on the Greek mainland and islands for the months of May, June, July and August [1]. This has impacted thousands of people, including families and vulnerable individuals, who are reliant on state-provided support while they live in remotely located camps, far from urban areas and without reliable provision of transport by the state to allow them to access essential services such as hospital appointments and attend necessary appointments as part of their asylum procedures. In this context, cash support is a vital lifeline.

The cash assistance programme is financed under the EU Asylum, Migration and Integration Fund (AMIF) and is intended to allow Greece to meet its legal obligations to provide material reception conditions to asylum seekers which enable people to obtain a dignified standard of living [2].

The undersigned organisations are aware of multiple cases where individuals and families – including those with vulnerabilities – have been severely impacted by the extended interruption to cash payments. One family from Palestine living in Northern Greece with a 1 year old child who have not received cash assistance for multiple months, expressed desperation and severe frustration regarding the lack of financial support to cover their daily living expenses. Another case concerns an asylum seeking family with a son who has a disability, who are living in a camp in the Attica region and have not received financial assistance for many months. They shared the devastating impact of the stop to cash assistance on their ability to meet their most basic needs while living in remotely located camps, and the anxiety induced by not receiving information on when payments will start up again.

Since July 2021, cash assistance is only available to asylum seekers who can prove their continued residence in a facility operated by the Ministry, for instance a refugee camp [3]. Even when paid out, the amount of financial aid is pitiful: €75 per month for single people, €135 for couples or single parents with one child, or €210 for families of four or more, in cases where applicants are provided with catered accommodation. In a recent report by Mobile Info Team and Refugee Legal Support, 93% of people asked about cash assistance shared that the amount was insufficient to cover their basic living expenses. The lack of consistent provision of Non-Food Items (NFIs) in camps and frequent interruptions to transportation and interpretation services, has further pushed people into isolation during the asylum procedure.
